If you do not agree to these terms, you may not use this site. Delaware Valley Pagan Network, Inc. (DVPN), sponsor of the Pagan Arts Initiative (PAI), reserves the right, at any time to modify, alter, or update these Terms of Use, and you agree to be bound by such modifications, alterations and updates.

When you visit pai.dvpn.org or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Everything on our web site is copyrighted (unless otherwise noted) and may not be used except with our express written consent. This means that any use of any graphics, images, photographs, text, drawings, paintings or any part of the site by you or other third parties is strictly prohibited and may violate federal copyright laws, international treaties and other state, federal and international laws. Nothing contained on this site may be construed as granting any you or any third party any license or right to use any copyrighted works.

All trademarks, service marks, and trade names, including without limitation the trademarks Pagan Arts Initiative and Delaware Valley Pagan Network (collectively the "marks") that appear on the site are owned by and proprietary to Delaware Valley Pagan Network, Inc. or other respective owners that have granted Delaware Valley Pagan Network the right and license to use such marks. You shall have no right or interest in or to any of these marks, and any use of these marks by you or any other person or party is strictly prohibited.

DVPN grants you a limited license to access and make personal use of this site and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of DVPN. This license does not include any resale or commercial use of this site or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this site or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools. This site or any portion of this site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of DVPN. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of DVPN, PAI, and our affiliates without express written consent. You may not use any meta tags or any other "hidden text" utilizing DVPN's name or trademarks without the express written consent of DVPN. Any unauthorized use terminates the permission or license granted by DVPN. You are granted a limited, revocable, and nonexclusive right to create a hyperlink to the home page of pai.dvpn.org so long as the link does not portray DVPN, PAI, or our affiliates, or their products or services in a false, misleading, derogatory, or otherwise offensive matter. You may not use any DVPN logo or other proprietary graphic or trademark as part of the link without express written permission.

This site may include links to other sites on the Internet that are owned and operated by other artists, vendors, and/or other third parties, including without limitation to the site(s) PayPal.com and pai.dvpn.org (the "external sites"). You agree that Delaware Valley Pagan Network, Inc. is not responsible for the availability of, or the content located on or through, any external site. You should contact the site administrator or Webmaster for those external sites if you have any concerns regarding such links or the content located on such external sites. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any content, goods or services available on or through any such site or resource.

In the event a product is listed at an incorrect price due to typographical error or error in information received from our artists, we shall have the right to refuse or cancel any orders placed for products listed at the incorrect price. Delaware Valley Pagan Network shall have the right to cancel any such orders whether or not the order has been confirmed and your credit card has already been charged for the purchase.

The receipt of an e-mail order confirmation by Delaware Valley Pagan Network does not constitute the acceptance of an order. Acceptance of an order by Delaware Valley Pagan Network shall occur only after Payment has been received from you by Delaware Valley Pagan Network. Verification of information may be required prior to the acceptance of any order. We have a five day approval policy for fine art work purchased by credit or check card through Pay Pal.com and a ten day approval policy for fine art purchased check or money order sent via Parcel Post. 

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. DVPN does sell products for children, but it sells them to adults, who can purchase with a credit card. If you are under 18, you may use DVPN only with involvement of a parent or guardian. DVPN and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.

Visitors may post event listings, comments, and other content; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam." You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. DVPN reserves the right to remove or edit such content.

PAI member artists retain full rights to the content they post in their personal galleries. If you post other content or submit other material, and unless we indicate otherwise, you grant DVPN, PAI, and its affiliates a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant DVPN and its affiliates and sublicensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify DVPN or its affiliates for all claims resulting from content you supply. DVPN has the right but not the obligation to monitor and edit or remove any activity or content. DVPN takes no responsibility and assumes no liability for any content posted by you or any third party.

DVPN, PAI, and our affiliates respect the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please follow our Notice and Procedure for Making Claims of Copyright Infringement.

Parties other than DVPN, PAI, and our subsidiaries operate stores, provide services, or sell product lines on this site. We provide links to the sites of affiliated individual artists and arts companies and certain other businesses. We are not responsible for examining or evaluating, and we do not warrant the offerings of, any of these businesses or individuals or the content of their Web sites. DVPN does not assume any responsibility or liability for the actions, product, and content of all these and any other third parties. You should carefully review their privacy statements and other conditions of use.

This Agreement shall be interpreted and governed according to the laws of the Commonwealth of Pennsylvania, USA, regardless of any conflict of laws provisions, and venue for any claim or action shall lie exclusively in the courts of the Commonwealth of Pennsylvania or the federal courts sitting therein.
